Gov. Scott Strengthens E-Verify Executive Order

Florida Gov. Rick Scott has modified an Executive Order that requires agencies and contractors under the direction of the governor’s office to use E-Verify. Gov. Scott signed the original order as one of his first acts in office. The new executive order strengthens the language requiring the use of E-Verify of subcontractors of state agencies.

Florida is one of seven states (Utah, Idaho, Oklahoma, Missouri, Georgia, Virginia, and Georgia) with laws in place that require state agencies and contractors of state agencies to use E-Verify. Five states require all or most employers, private and public, to use E-Verify.

Gov. Scott’s executive order states (new language is bold):

I hereby direct all agencies under the direction of the Governor to include, as a condition of all contracts for the provision of goods or services to the state in excess of nominal value, an express requirement that contractors utilize the U.S. Department of Homeland Security’s E-Verify system to verify the employment eligibility of all new employees hired by the contractor during the contract term, and an express requirement that contractors include in such subcontracts the requirement that subcontractors performing work or providing services pursuant to the state contract utilize the E-Verify system to verify the employment eligibility of all new employees hired by the subcontractor during the contract term.
