The Obama Administration announced a proposed rule that would give work authorization to the spouses of certain H-1B workers, increasing job competition for the 20 million Americans who want full-time work but can’t find it. It does not appear that these spouses will be counted against the visa cap on the category of job they pursue, so the move would expand immigration by executive fiat.

The proposal would, for the first time, allow work permits for the spouses of H-1B workers who have begun the process of applying for a green card through their employers. Currently their spouses can move to the U.S. with them, but are prevented from working.

DHS Deputy Secretary Alejandro Mayorkas said the proposed rule is meant to keep America competitive as more countries offer incentives to attract the workers. "The proposed rules announced today provide important support to U.S. businesses while also supporting economic growth here in the U.S.," he said. "This enhances our country's competitiveness to attract skilled workers from other countries.” Mayorkas said that about 97,000 people could benefit from the proposal in the first year, and 30,000 each year after.

Reacting to the proposal Stephen Miller, a spokesman for Sen. Jeff Sessions, R-Ala., said "The U.S. already provides businesses with 700,000 temporary guest workers every year to compete against unemployed Americans, in addition to the annual flow of 1 million permanent legal immigrants. The administration's unilateral decision to increase that number will hurt already-struggling American workers."

A second rule announced today would make it easier for foreign workers from Chile, Singapore, Australia and the Northern Mariana Islands to extend their stays in the U.S. Workers from these countries who have at least a bachelor's degree in a specialized field are currently allowed to extend their stay, but must document their work history. The proposed rule would give these workers more time in the U.S. and make it easier for them to get DHS approval.

A third proposed rule would facilitate the ability of foreign professors and researchers to extend their stays under the EB-1 visa category.

At the same time Senator Warren is proposing that student loans be subsidized longer after graduation- seems that weak labor markets and low earnings is making it difficult to pay back the loans. Is it not time to stand up for educated workers against the cheap labor interests? For whatever it is worth, I have expressed my concern to the White House. Deep pocket contributors generally win - but voters at least count a little.
It seems that the administration when they talk to stakeholders about proposed changes and shuns American educated workers.

I read the rules will be published on a federal government Web site and will be open to public comment for a period of time. We all need to go there and blast these rules.

Durbin, Levin and others urged Obama to do stop non enforcement against young illegal. The beast has tasted blood and it has been confirmed that it is difficult to stop illegal acts through the courts. A divided Congress takes impeachment off the tables. The constitutional argument of the administration that Congress would not pass the bills that I wanted so I acted does not have strong merit.

I disagree that Obama is "punishing" us for resisting amnesty.  I believe his plan for ending American sovereignty as we know it existed long before he scurried into the White House with the help of millions of awe-struck Americans and a subservient media.

I tend to agree with you, Dave,but Obama ran at the right time, with the country in the tank and looking for change. Different time it may have been another story. Now the challenge is that we do not get so hungry for change that it gets messed up even more in '16.

The courts have made it difficult for people to stop illegal acts by administrations. It seems that the courts in their desire to stay out of political dog fights have gone too far. Waiting for the next election is not always an answer- the next election might be 8 years away and candidates are judged on portfolios of issues. Impeachment requires a very high degree of contempt for an act and an abandonment of party cohesion.

STEM Jobs Should Be Reserved For Americans.

Increasing immigration, especially STEM, in such a weak labor market is the definition of insanity.

If I read the article correctly, the current influx is 700k 'temporary' + 1m 'permanent' = 1.7m new workers per year. The US economy only produces about 2 million new jobs per year, so they appear to all be going to immigrants. WHY ARE WE DOING THIS ???

America needs to REDUCE IMMIGRATION. Wall Street collapsed almost 6 years ago, taking 10 million jobs away in just 12 months. Let's get Americans back to work. This immigration excess is ridiculous.

I predicted over 6 months ago that Obama would pass immigration by executive order. I recall that Van at the time ,said it would be illegal and Congress would have grounds to sue the administration. This scenario is playing out precisely as predicted. The republicans have failed to make their voices heard. Jeff Sessions is the only one brave enough to speak out. We are a now a trend-follower, as many other countries have already adopted this stance, and it works, as they are doing well: e.g. Australia, Canada, Israel, Saudi Arabia, Switzerland, and the UK.

Yes, I agree with Mike about not being down. And so that people are not confused, there is a difference between an executive order -- something issued by Obama himself -- and administrative action taken by DHS. None of the recent actions are executive orders, which can be readily challenged in court by a Member of Congress. They're administrative actions that do not confer a permanent legalization. I also disagree that others are not speaking out. Plus we're gaining traction despite the efforts of the MSM to downplay Obama's actions. For example, the nonsense about record deportations has been debunked. It's difficult to stop these administrative actions. In any event, we should be focusing on preventing Congress from legalizing illegal aliens and increasing legal immigration.

So here is the summary of it all:

- Proposed rule will submitted in the Federal Register to be opened for Public comments probably by the end of this week. (Based on the Daily Beast)
- According to EO 12866, it will be open for public comments for 60 days.
- According to most articles, DHS and OMB will expedite the comments review and fast track the proposed rule to its final stage and publish it. It is expected that the proposed rule will remain as it was published today by DHS.

Let us prepare to submit comments and defeat this proposal. If Proposed rule becomes law, it will award 100,000 lifetime work permits to foreign cheap labor. It will take away American jobs and depress wages.

This is so full of BS...I went to a website and the wives feel loss of identity, depressed, loneliness, and the feeling of being limited by a family with a 1-person breadwinner so therefore they should be allowed to work instead of being at home...apparently we are suppose to be non existent...it is amazing to me the weak, senseless excuses that are given by these workers, and illegals to come to and stay in our country...perhaps we should come up with some silly excuses also, maybe that's what it takes...

Your right, it is BS. They need to join an International Group or set up one for their area! These groups are all over the U.S. When I lived in NC the first time, I knew many women from overseas. (They were so giving, that occasionally they even asked me, if I would like to join them.) Many were glad they were getting a vacation from work, but most were grateful they had the opportunity to just be here. The wives on the website you referred to, obviously knew they would not be the breadwinner before they came to the U.S. There is a solution though, if they are not happy about it.

First the "dreamers" ("kids" up to age 37?), then proposals for kids who were brought here by their parents to join the military to gain legal citizenship (problem is, the military is down-sizing), and now the spousal green cards. Democrats are with him for the voters it will create, and Republicans want the market flooded with laborers to drive down wages and increase their own filthy profits. Originally, the bill written by the Gang of Eight, only gave that authority to the Secretary if the home country of the foreign national did the same for U.S. workers. The Gang of Eight’s bill said, “The Secretary of Homeland Security shall authorize the alien spouse to engage in employment in the United States only if such spouse is a national of a foreign country that permits reciprocal employment.”

The intent of the authors of the Senate bill was to ensure that American spouses were treated equally. The rule does not take this into consideration.

The Obama administration claims it wants immigration reform, but they can’t wait for Congress. They act on their own. And, they do it to the detriment of American workers. We need to get immigration reform right, and doing ad-hoc rules that fly in the face of the statute are not helpful to the process.

In addition to their lack of compassion and understanding for American workers, it’s disturbing that the administration is once again circumventing Congress and implementing their own rules. As with other unilateral actions this administration has taken, I question their legal authority to issue this rule.

In 2001, Congress explicitly laid out in statute that the Secretary could provide work authorizations to certain spouses of foreign workers. Congress said that work authorizations could be given to spouses of L1 (intercompany transfers) and E (treaty traders/investors) visa holders. Congress did not, at that time, give spouses of H-1B visa holders the permission to work.

The political problem is that their are employers that can directly identify their gains from cheap labor on the other side are the generally politically unorganized workers, It is difficult for a particular worker to identify exactly how he is damaged. Why do politicians favor giving amnesty and citizenship to illegal immigrants that have been in defiance of our laws for decades, when current estimates are that there are at least 3 unemployed Americans for every job available? You politicians that are in favor of amnesty for illegal immigrants that are already in America have 3 motives: One (most prevalent) reason is votes. Granting amnesty just to prop up your voting pool is reprehensible due to the (negative) consequences of this action. The second is simply changing the law to fit the raucous illegal's demands, so you don't have to deal responsibly or intelligently with the issue. This is called dereliction of duty, and wilful disregard for upholding the laws of our Constitution, which you are sworn to do. Third, you have put yourself in debt to big business, and must obligingly provide the cheap labor they demand.
If immigration does need reform, it needs to start with enforcement of current laws. That said, any reform shouldn't begin with giving amnesty to close to 40 million (YES, 40 MILLION) illegals that have been in defiance of Americas laws for decades. The 11 million number being circulated is a fallacy. Nor should we open the borders to unlimited immigration. America cannot be the world's destination for all immigrants looking for a "golden egg", provided at legal hardworking American taxpayer's expense. Otherwise, America will become exactly what these illegals are fleeing from now.

The citizens of the United States not only deserve but are guaranteed the total support of their elected civil servants. That is correct, civil servants, elected and appointed officials paid for with the hard earned dollars of every American taxpayer, not the special interest groups like La Razza or George Soros and the largest corporations and their highly paid teams of political lobbyist. We are not asking that legal American citizens be given first choice for each and every available job opportunity and opening, we are demanding it. Playing political games for personal power and wealth by members of Congress and the Administration will be stopped by the American people and every legal registered voter. Reduce the number of legal immigrants permitted to enter the U.S.A. annually. Reduce measurably the number of H1-B visas and green card opportunities until America's true unemployment rate is below two(2) percent. Do not unlawfully make changes to our existing Immigration Statues by way of executive fiat or failure to enforce them. There will be no amnesty, pathway to citizenship or release of imprisoned illegal immigrants in America.

Is he nuts? (Rhetorical question - we know he is). There are millions of people already in this country who can't find part-time jobs, let alone full-time. Why bring in more to compete for the few jobs that are out there? He wants to 'raise the minimum wage to a 'livable' wage'? How's he going to do that when a business has 40 or 50 people competing for the same job? You think a foreign worker whose spouse now has a green card, too, is going to hold out for that $15 or $10.10 an hour wage? Oh, maybe the employer will pay the new minimum but cut out other benefits. He'll keep workers below 30 hours a week, hire fewer, etc. We do NOT need more 'guest workers'. We have workers. What we need are JOBS and the idiots in Congress are too blind to see it and we have a President who doesn't care. He *says* he cares but he doesn't or he wouldn't be doing what he's doing. He is not helping workers. I have no idea who he *thinks* he's helping but it sure as hell isn't the American people.

I have for the reasons you have stated not voted for either party. When the leaders, who are the primary speakers and planners of the parties, will not provide us audience or results, then I do not belong in that party. They are so sure that they are right, they do not want me in that party.

After 28 years of not fulfilling the "promise" of amnesty first then secure borders, both parties have had all the chances they should get to act like and act for Americans. Now what seems to be likely presidential candidates in '16, one from either party, both are advocates of what has already been, so I do not see leaders of either party in the next cycle performing for Americans, either. Fool me once, shame on you, fool me four or more times I am shamed beyaond enbarrassment!!
